Be Aware Hoax -Scullery & Holz Interiors Pty Ltd

The hearing at CTTT on 15th December 2010 was attended with Stefan Mayer arriving twelve minutes late (again). On our way to the hearing, we had a call from another unhappy customer of Scullery & Holz, stating that the company was now on the "insolvency list". This was mentioned to the Member at the CTTT. When Stefan Mayer was asked if that was the case he stated that it could well be from Friday 16th December 2011.
We presented our claim in the format required by the CTTT on a Scott Schedule ( down loaded from the http://www.cttt.nsw.gov.au/pdfs/Dispute_resolution/Forms/scottsschedule1.pdf).

The respondents to our claim now have until 19th January 2012 to respond. A.J.K Constructions Pty Ltd is the other respondent. This company is also not licensed to do building or electrical work. A.J.K Constructions Pty Ltd failed to provide Home Warranty Insurance and a Certificate of Compliance for the electrical work done in our kitchen.

My understanding of the law is that if a director of a company continues to trade while the company is insolvent then personal assets of the director can be accessed to pay the creditors of the company.

It could be in the interests of all you unhappy customers of Scullery & Holz Interiors Pty Ltd to join together and perhaps make a Class Action Claim against them. Additionally if you all lodge complaints with the ASIC stating that you believe the Company was operating while insolvent, then the ASIC could well investigate them. We have already lodged such a complaint with the ASIC. Their response was that at this stage they would do nothing. However if four or more of you lodge similar complaints then ASIC may take notice.

We are told by another unhappy customer of Scullery & Holz that they have paid $27,000.00 so far with nothing to show for it. Stefan Mayer has a knack of winning the sympathy of his customers and wheedling large sums of money from them with very convincing stories of hardship. He is expert in persuasion by flattery and guile. Beware of his promises and do not believe a word he says. What a terrible way to run a business! His father Tom is also expert in procrastination and giving misleading information regarding the progress of the work being carried out.
